Independent Media: recurring allegations of editorial interference and use of titles to defend owner's interests

No legal proceedings

Since acquiring Independent Media, Survé has been at the centre of recurring controversies over editorial independence. Editor Alide Dasnois's dismissal after unfavourable coverage fuelled this debate before a settlement in 2016. In 2024, the Press Council also ruled, in the Karyn Maughan case, that the Sunday Independent had allowed corporate interests to influence an editorial decision and had breached rules protecting reputation and protected comment; the group was subsequently expelled from the Press Council system after refusing to comply with the ruling.

Termination of banking relationships with Sekunjalo Group and legal battle over "de-risking"

Civil / administrative proceedings

From 2020–2021, several banks closed or sought to close accounts held by Sekunjalo-linked entities, citing reputational and compliance risks and transactions they regarded as concerning. Sekunjalo challenged the decisions before the Competition Tribunal and courts. In December 2023, the Supreme Court of Appeal confirmed that a bank could terminate a relationship under the contracts concerned; a subsequent constitutional appeal did not reverse the outcome.

Independent Media's financial crisis and announced withdrawal of Sekunjalo financial support

No legal proceedings

In July 2026, Sekunjalo announced that it could no longer continue financing Independent Media after stating that it had invested more than R5.2 billion in its media activities. The decision cast doubt on the viability of historic newspapers and the future of jobs, while a new publishing structure and associated companies were being established. Survé had also announced his withdrawal from several formal positions.

SACTWU debt: Supreme Court of Appeal opens way for payment of at least 458.6 million rand

Civil / administrative proceedings

The dispute arose from a R150 million loan provided in 2013 by SACTWU Investments Group to finance the acquisition of Independent Media. On 26 March 2026, the Supreme Court of Appeal ordered Sekunjalo Independent Media to pay exactly R458,606,995.07, plus default interest from 29 August 2023. The judgment also describes Survé's role in proposed exits and repayments after the failure of Sagarmatha.

Multiple defamation proceedings against media: allegations of intimidation strategy or "SLAPP"

Civil / administrative proceedings — against a third party

Protagonist is the victim — these proceedings are not counted in their formal charges or convictions.

Survé and companies in his group brought or threatened several defamation actions against media outlets and journalists investigating their affairs. GroundUp identified at least six news organisations sued in 2022 and described the series of claims as a form of intimidation/SLAPP. In the GroundUp/Daily Maverick case, GroundUp reported no substantive procedural developments as at 12 December 2024.

PIC's R4.3 billion investment in AYO: valuation and pension funds

Civil / administrative proceedings

The PIC invested R4.3 billion in AYO Technology Solutions at its stock market flotation. The Mpati Commission subsequently identified serious valuation and governance anomalies, citing, in particular, manipulation of valuation figures and pressure from above surrounding the investment. The PIC–AYO civil litigation ended in a settlement in 2023.

"Tembisa 10": public defence of decuplets story discredited by internal ombudsman and unsupported by Public Protector

No legal proceedings

In 2021, Independent Media's Pretoria News published the story of the birth of decuplets known as the "Tembisa 10". The group's internal ombudsman concluded that the report failed basic journalistic standards, called it a hoax and recommended an apology. Survé nevertheless continued publicly to defend the existence of the babies and the possibility of a cover-up. Subsequent official investigations found no evidence supporting the decuplets' birth.

African News Agency: R25 million transferred to Survé's personal account and conflicting explanations

No legal proceedings

Banking documents disclosed in the "de-risking" litigation show that approximately R25 million was transferred from African News Agency to Survé's personal account. Sekunjalo initially told Nedbank that the payment was linked to a divorce settlement; Survé subsequently said it was actually a payment under an intercompany loan between ANA and Sekunjalo Investment Holdings.

AYO: FSCA investigation into possible share price manipulation and contested search warrant

Investigation

The Financial Sector Conduct Authority investigated AYO transactions between 2017 and February 2019 following a referral from the JSE. An affidavit used to obtain a search warrant described the dominant role of Survé-linked companies in purchases of AYO shares and examined whether certain transactions had artificially supported the share price, particularly during a price protection period linked to the PIC.
