Release ordered in 2022, continued detention and reinstatement of prosecution by Supreme Court

Conviction

In October 2022, the Court of Appeal quashed the terrorism charges and ordered Kanu's release because of his unlawful transfer from Kenya. The government challenged the decision, and Kanu remained in detention. In December 2023, the Supreme Court overturned the procedural acquittal and ordered the trial to resume.

Protagonist is the victim

Protagonist is the victim — these proceedings are not counted in their formal charges or convictions.

Kanu was arrested in Kenya in June 2021 and returned to Nigeria without an ordinary extradition process. In 2022, the Court of Appeal held that the extraordinary rendition breached extradition rules and his rights; the Supreme Court subsequently confirmed that the transfer was unlawful, unfair and oppressive.
