Strawberry Fields Tax Case: Withdrawals of Approximately NOK 795 Million and Anti-Avoidance Rule Applied, Supreme Court Appeal Refused

Civil / administrative proceedings

Following the acquisition of Oslo Properties/Strawberry Fields, a substantial paid-in capital position enabled withdrawals which Stordalen regarded as tax-neutral. The authorities argued that the acquisition's principal purpose was to exploit this tax position and that the former anti-avoidance rule should apply. The courts largely upheld the authorities' position, with more than NOK 400 million at stake over the years concerned.

Tax Deduction of NOK 80 Million Linked to Ringnes Settlement: Appeal Victory but Case Accepted by Supreme Court

Civil / administrative proceedings

A separate case concerns the tax deductibility of the NOK 80 million paid to settle the Ringnes dispute. Following adverse rulings, Stordalen succeeded before Borgarting in February 2026, with the majority finding that the payment could be linked to protecting the revenue base and reputation. However, on 28 May 2026, the tax authorities obtained permission for their appeal to be heard by the Supreme Court.
