European parliamentary immunity: lifted by Parliament, then annulled by the CJEU in 2026 over rapporteur's lack of impartiality

Civil / administrative proceedings

After being elected to the European Parliament, Puigdemont enjoyed parliamentary immunity. In 2021, Parliament voted to lift it at Spain's request. The General Court upheld that decision in 2023, but in February 2026 the Court of Justice annulled Parliament's decisions, ruling that the rapporteur handling the requests lacked the required guarantees of impartiality because of his political links.

Amnesty law: Supreme Court refuses to apply it to his misuse of public funds and maintains arrest warrant; constitutional appeal pending

Formally charged

The Supreme Court refused in 2024, and confirmed on appeal in 2025, the application of the amnesty law to Puigdemont for misuse of public funds, considering that he had obtained a financial benefit within the meaning of the law's exception. The national arrest warrant therefore remained in force. His amparo constitutional appeal was admitted by the Constitutional Court, which refused in January 2026 to suspend the warrant provisionally. As at 2 September 2026, the substantive case remained pending.

2017 procés: criminal investigation, arrest warrant and departure for Belgium after unilateral declaration

Formally charged

Following the referendum of 1 October 2017 and the declaration of independence, Carles Puigdemont was removed from office under Article 155 and settled in Belgium. The Supreme Court subsequently pursued him for events relating to the procés, initially including rebellion and, following criminal law reforms, disobedience and misuse of public funds, with successive arrest warrants.

Arrest in Germany: extradition accepted only for misuse of public funds, refused for rebellion, then European warrant withdrawn

Formally charged

Puigdemont was arrested in Germany in March 2018 under a European warrant. The Schleswig-Holstein court ultimately accepted possible surrender for misuse of public funds but rejected the rebellion allegation because there was no sufficiently equivalent offence involving comparable violence. The Spanish judge refused limited extradition and withdrew the European warrant then in force.

Formally charged — against trois agents des Mossos d'Esquadra

Protagonist not prosecuted — these proceedings are not counted in their formal charges or convictions.

On 8 August 2024, Puigdemont publicly reappeared in Barcelona before Salvador Illa's investiture, gave a speech and then evaded the police operation despite an outstanding national arrest warrant. The Mossos launched "Operación Jaula" without managing to arrest him and subsequently acknowledged operational errors. In 2026, a judge prosecuted three officers suspected of helping him.

Court of Auditors: accounting liability for procés expenditure remains pending after 2026 CJEU ruling

Civil / administrative proceedings

Puigdemont is among approximately thirty former Catalan officials facing Court of Auditors proceedings over spending connected with the referendum and the external activities of the procés. Following the CJEU's July 2026 ruling on the amnesty law, the accounting court did not immediately close the case and asked the parties to address the possible origin of EU funds.

Voloh case and suspected Russian links: criminal route against Puigdemont definitively closed in 2025

Investigation

Branches of the so-called Voloh investigation examined possible contacts between the pro-independence movement and Russian actors before or after the 2017 referendum, including allegations of attempts to secure international support. In 2025, after the Barcelona Provincial Court closed that branch, the Supreme Court ruled out opening a high-treason investigation against Puigdemont.

Tsunami Democràtic: Supreme Court terrorism investigation closed in 2024 after late investigative measures invalidated

Investigation

In 2024, the Supreme Court opened an investigation into Puigdemont and MP Ruben Wagensberg over possible involvement in Tsunami Democràtic, a movement behind mass demonstrations following the conviction of procés leaders. In July 2024, the investigating judge closed the case after the National Court invalidated investigative measures carried out beyond the statutory deadline.
