2010–2015

Long-running dispute over subcontracted workers deemed Hyundai employees by courts

Civil / administrative proceedings

Under Chung's presidency, Hyundai Motor faced years of legal action by in-house workers formally employed by subcontractors. Courts repeatedly concluded that some were in fact under Hyundai's direct control and should receive regular employee status; in 2014, nearly a thousand workers obtained recognition and compensation, and a 2015 agreement provided for the recruitment of 6,000 in-house subcontracted workers.

Conviction

Chung Mong-koo was found guilty of organising off-the-books funds and embezzling tens of billions of won from Hyundai Group companies. Following appeal and a Supreme Court referral concerning the form of the community service sanction, the final sentence remained three years' imprisonment suspended for five years, together with 300 hours of community service.

Criminal breach of trust involving recapitalisations and affiliated-company transactions to support or transfer value

Conviction

In the same criminal trial, but concerning different economic conduct from slush fund embezzlement, Chung was found guilty of criminal breach of trust, notably in connection with capital increases at Hyundai Space & Aircraft and Hyundai Steel Pipe, as well as bond transactions and the Bontec capital increase. The courts found that these operations had imposed substantial losses on group companies.

2008 presidential pardon while some community service remained outstanding

Conviction

In August 2008, Chung received a presidential pardon and rehabilitation, alongside several other major business executives, following his conviction in the Hyundai case. The measure prompted debate over leniency towards chaebol leaders; some of his community service hours had not yet been completed.
