Contentieux de brevet Roche/Cipla sur Erlocip (erlotinib)

Le contentieux a débuté en 2008 lorsque Roche a cherché à faire interdire l’Erlocip de Cipla. Les demandes d’injonction provisoire ont d’abord échoué. En novembre 2015, la Delhi High Court a renversé le rejet de l’action en contrefaçon, retenu que Cipla devait rendre des comptes sur la fabrication et la vente d’Erlocip et accordé des dépens à Roche; aucune injonction n’a été accordée en raison de l’expiration imminente du brevet.
