French deportation order: initial suspension, approval by Council of State and subsequent ruling on merits

Civil / administrative proceedings

On 29 July 2022, the Minister of the Interior issued a deportation order against Iquioussen and withdrew his residence rights. The Paris Administrative Court initially suspended the measure in urgent proceedings, but the Council of State overturned that suspension and authorised deportation. In March 2024, the Administrative Court also upheld the order on its merits.

European Arrest Warrant refused by Belgium, followed by Belgian deportation to Morocco

Civil / administrative proceedings

After leaving France for Belgium, Iquioussen became the subject of a French European Arrest Warrant for evading enforcement of a removal order. Belgian courts refused to surrender him to France, finding, in particular, that the acts underlying the warrant did not constitute an offence under Belgian law. Belgium ultimately deported him to Morocco in January 2023.

ECtHR application: interim measure refused and application subsequently declared inadmissible

Civil / administrative proceedings

On 4 August 2022, the ECtHR refused urgently to order suspension of his removal. In June 2023, it unanimously declared his application against France inadmissible, notably because actual deportation to Morocco had been decided by Belgium and because certain domestic French remedies had not been exhausted.
