Amende CNB de 7,5 M CZK sur le remboursement anticipé des hypothèques : décision judiciaire annulée et renvoyée

Civil / administrative proceedings

La ČNB a imposé à Komerční banka 7,5 millions CZK pour son traitement de remboursements anticipés d’hypothèques de 1 116 clients en 2019–2020. En 2025, la Cour administrative suprême a annulé le jugement du tribunal municipal qui avait maintenu la décision et lui a renvoyé l’affaire; le jugement cité ne tranche pas définitivement la légalité de tous les frais contestés.

Les opérations de lettres de crédit liées à B.C.L. Trading ont conduit Komerční banka à constater près de 8 milliards CZK de pertes; une commission tchèque des valeurs mobilières a annoncé en 2000 une amende de 3 millions CZK liée à la communication tardive et inexacte de risques. Onze responsables historiques ont fait l’objet de poursuites; neuf anciens administrateurs ont été acquittés au premier procès de décembre 2005 puis de nouveau au jugement de janvier 2007.
