Ivan Pillay's early retirement and re-employment: fraud charge withdrawn, then Public Protector report overturned

Case dismissed / dropped

The National Prosecuting Authority prosecuted Pravin Gordhan for fraud in 2016 over his authorisation for Ivan Pillay to take early retirement before being re-employed at SARS. The charges were withdrawn on 31 October 2016. The same underlying facts were subsequently revisited in a Public Protector report concerning Pillay's pension; in December 2020, the High Court set aside that report, and an application for leave to appeal subsequently failed.

Public Protector's report on SARS "rogue unit": adverse findings ultimately overturned

Civil / administrative proceedings

In 2019, Public Protector Busisiwe Mkhwebane issued an adverse report about Gordhan concerning the SARS investigative unit often called the "rogue unit", including findings about his conduct and remedial measures. Gordhan first secured suspension of the measures and, in December 2020, a full bench of the High Court set aside the report.
